LANGUAGE
INTRODUCCIÓN
Antes
de pasar a la evolución de este
artículo, conozcamos el significado
de la palabra plagio aportado por la
R.A.E.:
"Plagio:
del latín plagium. 1. Acción y
efecto de plagiar (copiar obras
ajenas)
Plagiar:
1.Copiar en lo sustancial obras
ajenas, dándolas como propias".
Aunque
hay más acepciones, la que nos
interesa en cuestión es ésta.
¿Recuerdan
aquellos libritos de 5 paginas que
llevaban 3 muñecas, y un montón de
vestidos y complementos, que tras se
recortados, uno a
su antojo podía quitar y poner?.
Aquel inteligente invento se hizo
para las familias cuyos recursos
económicos no permitían gastarse
los dineros en muñecas de las de
verdad.
Pasaron
los años, y llegaron las nuevas
tecnologías. Como padres que no
tuvimos muchas cosas, deseamos que
nuestros hijos disfruten de ellas y
ponemos a su disposición la mayor
biblioteca del mundo: Internet.
Internet
dispone a su vez de mayordomos que
nos facilitan el trabajo, llamados
buscadores. Tan sólo hay que
decirle al mayordomo "búscame
tal cosa" y en cuestión de
segundos se ofrecen variopintas
posibilidades de lo que necesitamos.
Nuestros
hijos apenas leen un libro de los
que deben comentar en sus tareas
escolares. Entran en Internet y el
mayordomo a certeza les trae el
libro ya comentado. A veces tienen
la osadía de copiar textos enteros
que no son de su cosecha cerebral, y
los profesores se ven en la
obligación de ejercer de policías
del plagio a diestro y siniestro
para poder evaluar.
DE
LA ESCASA IMAGINACIÓN
El
caso más preocupante, es el
incremento de webs que se ha
disparado en los últimos años. No
hace falta ser un ducho en la materia
para hacerse una. Basta con buscar
un hosting gratuito y ellos te
facilitan todas las herramientas con
plantillas para que tu proyecto
llegue a buen puerto.
Suele
ocurrir que todo el mundo busca la
originalidad en el diseño de la
misma para conseguir más
visitantes, y es aquí donde la
escasa imaginación o adquisición
de herramientas necesarias para
ellos hace de Internet una vuelta en
el tiempo, recordándonos las
famosas recortables de los años 70.
Le
decimos al mayordomo que nos busque
fondos para web. En segundos
obtenemos tropecientas mil páginas
con fondos, visitamos unas cuantas y
cuando encontramos ese color que
necesitamos o esa imagen que
necesitamos, la guardamos en nuestro
PC con CORTAR Y PEGAR o GUARDAR
COMO.
Con
esta acción queda demostrado que
Internet es una especie de
"salvaje oeste" donde cada
uno coge lo que quiere sin
importarle de quien es.
Varios
métodos de ofrecimientos hay en la
red:
a)
gratis o freeware: donde podemos
coger gratis lo que queramos, aunque
no sabemos si lo que cogemos tiene
derechos de autor de otra persona.
b)
el linkware: donde podemos coger lo
que queramos pero con la condición
de establecer en nuestra web un link
hacia la web de la que cogimos el
material, aunque hay que reseñar
que con la descarga de productos no
adquirimos los derechos de autor.
c)
el shareware: donde quizás tengamos
que pagar una pequeña cantidad para
poder adquirir el derecho a uso, que
no el derecho de autor.
Llegados
a este punto, en infinidad de casos,
los apartados b) y c) no se respetan
para nada.
Todo
el mundo se cree en el derecho de
coger lo que quiera de donde quiera,
porque la gente piensa "si
está ahí es para cogerlo". En
un número inferior de casos, la
gente pone el link correspondiente o
paga por el uso de algo.
En
la vida real todo lo que necesitamos
está ahí afuera de nuestra casa.
Si uno necesita un cuadro NO LO
ROBA, lo compra, aunque sea en un
rastrillo.
El
caso es que al cabo de un tiempo, lo
que le caracterizaba a un sitio por
la exclusividad del diseño ya no
lo es tanto, pues desarmados
RECORTABLES han cogido el fondo de
una web, al que le han pegado un gif
animado encima que ni si siquiera
tiene el mismo color de fondo, al
que le ha añadido el cuadro de un
pintor y del que ni siquiera se cita
"este cuadro es de fulano de
tal y que podrás ver si visitan en
su web CCC o el museo
menganito" y encima pegan una
poesía de un autor desconocido y
después de todo pegan su nombre
debajo". Como dirían mís
colegas chilenas "RELINDO"
el resultado.
Así
de triste señores. Los talentos se
están muriendo. La imaginación por
la forma de piratear se dispara. Los
derechos de miles de autores
vulnerados hasta la infinita
saciedad, y en muchos casos uno
tiene que hacer de tripas corazón
porque si les reclamas la autoría
de lo que es tuyo, te exigen que se
lo demuestres con la titularidad del
registro de la propiedad
intelectual, que en muchos casos no
la hay. Y encima se ofenden si no
pueden piratear un trabajo, como en
el caso de Alejandro Sanz que le ha
puesto un sistema antipirateo a su
último CD, harto de que vulneren
sus derechos, aunque estoy segura de
que no tardarán mucho en descubrir
una forma de piratearlo.
DISEÑADORES
VERSUS PLAGIADORES
Esta
batalla a la orden del día sucede
con aquellas personas que de forma
altruista, elaboran artísticamente
unas plantillas para gente que no
tiene idea o programa para diseñar.
Su método sencillo: bajarse un zip
con la plantilla e insertar tu texto
o tus fotos.
Atenerse
es debido a los términos de uso de
cada diseñador pero son muy comunes
en todos estos sitios:
"TODOS
los sets tienen que redireccionarse
a http://lawebdeldiseñador.(loquesea)
usando el logo que encontrarás a
disposición en el set que elijas.
2.No
enlaces directamente al URL de estos
gráficos. Eso se conoce como
"Robo de Banda" lo que
significa que los gráficos están
corriendo desde el servidor de otra
persona. Para guardar los gráficos
lo que NO debes hacer es dar click
al botón derecho del gráfico y
guardarlo en tu disco duro y luego
subirlos individualmente a tu
servidor, HAS DE bajar el archivo en
formato zip.
3.
Estos gráficos NO pueden ser usados
en sitios que contengan pornografía
o estén clasificados X. Hay una
gran diferencia entre contenido
adulto y pornografía. Así mismo,
ninguno de estos sets pueden usarse
en sitios que promocionen o
contengan odio, racismo, abuso a
menores, crueldad con los animales o
cualquier cosa de esa naturaleza..

Algunos sets usan imágenes de
artistas Contemporaneos y NO están
en venta. Todos los set que usan a
estos artistas tienen su permiso. Es
OBLIGATORIO que incluyas el logo y
el enlace hacia su sitio.
5.
NO se permiten alteraciones de
cualquier tipo en estos sets. Esto
incluye cambiar el tamaño de los
gráficos, recortarlos o mezclarlos
con otros sets, ect. No es necesario
que utilices todos los componentes
del set si no lo necesitas,
entendiéndose por componentes
barras, bullets o botones.
6.
Está absolutamente prohibida la
redistribución de estos sets en
cualquier forma. Esto quiere decir
que no puedes ofrecerlos desde tu
sitio a otras personas, si alguien
desea estos sets tiene que venir
aquí directamente a
descargárselos".
Estas
normas también suelen ofrecerse en
diferentes idiomas, como el inglés,
por tratarse del más universal.
Pero aunque estas normas fueran
ofrecidas en chino mandarín LOS

Analicemos
los puntos anteriormente citados.
Punto
1.- El saqueador en adelante
PLAGIADOR, supongamos que ya ha
cogido lo que le interesa de nuestro
trabajo, y no pone el logo- link
porque quiere aplicarse el gusto de
que le digan en su engordado libro
de visitas "tienes una web muy
bonita, que diseños mas estupendos
y apropiados".

2.- La falta de espacio que ofrecen
los hosting gratuitos agudiza los
ingenios de nuevo ¿de qué manera
hago para que se vea este dibujo si
ya no me queda espacio en el mío?
Lo enlazo a la que donde está y
punto. Por eso no nos extrañe que
la gente que tiene hosting de pago,
realice un desembolso extra cada
mes, y que cuando sobrepasan el
ancho de banda, las webs desaparecen
hasta el mes siguiente por haber
consumido el oficial de cada mes. En
muchos casos, hartos de esta
impropiedad acaban cerrando sus web
o mudándose de casa. De ahí que
veamos sitios de plagiadores donde
las imágenes tomadas sean un
cuadrado con un aspa en la esquina
superior izquierda. (para comprobar
esto basta con ver las propiedades
de la imagen).
En
ciertos hostings gratuitos con
almacenamientos pequeños, se da
hasta la posibilidad de poner la URL
donde está la imagen, entendiendo
el usuario que lo que está haciendo
está permitido y desconociendo o
haciéndose el loco del robo del
banda, claro está, el plagiador no
es quien tiene que pagarlo.

3.- Hasta ahora en mi amplio navegar
por la red no me encontré con
alguien que hubiera infringido este
punto, pero que a nadie le extrañe
que los haya.

4.- Estos diseñadores pasan largas
horas sentados al ordenador pidiendo
permiso de uso de autores vivos o
contemporáneos. Muchas peticiones
son rechazadas y otras son aceptadas
bajo los términos de uso que
imponga el artista. Además se
somete el trabajo a la evaluación
del mismo para su visto bueno.
Luego, en muchos casos el diseñador
exhibe en su web el comunicado por
escrito entre ambos artistas.
Para
los autores ya fallecidos hay otros
preceptos que están contemplados en
la Ley de la Propiedad intelectual,
pero por poner un ejemplo podemos
utilizar un dibujo de un cuadro que
haya sido pintado hace 300 años,
otro ejemplo La Gioconda de Leonardo
Da Vinci, pero poniendo el autor del
cuadro sea el caso que sea.

5.- Lo que no se puede hacer. Parece
que todo lo prohibido es motivo de
risa ¿que tú me vas a decir lo que
tengo que hacer yo, por favor? Si a
mí me amparan los derechos civiles.

6.- Como dijo el sabio "la
ignorancia es la felicidad". El
plagiador se lleva lo que le gusta
de su web y encima tiene el descaro
de ofrecérselo a sus amiguitos
"Miren que fondos mas bonitos,
se los regalo", incurriendo por
desconocimiento de nuevo en plagio.
Como
diría mi abuela "esta gente no
tiene sangre en la venas tiene
horchata"
NO
ESCUPIR PARA ARRIBA
No
hay otra cosa que más satisfacción
me de que al PLAGIADOR le plagien
algo que sea de su escasa cosecha,
aunque no esté bien esto que digo,
pero por lo menos se dará cuenta de
como se siente uno.
A
otros se la repampinfla y ni se dan
cuenta, y exigen que retiren de
inmediato su "fantástica
obra" por la cual serán
reconocidos por los hijos de
nuestros hijos (amén).

plagie este artículo por doquier,
aunque no se me respete el derecho

HISTORY OF THE PLAGIARISM IN INTERNET
INTRODUCTION
Before seeing the evolution of this article, let's know the meaning of the word plagiarism contributed by the Spanish Royal Academy of the Language:
I pirate: of the Latin plagium. 1. Action and effect of pirating (to copy foreign works)
To pirate: 1. To copy in substantial foreign works, giving them like own.
Though there are more meanings, this one is that we are interested in in question
Do they remember those books of 5 pages that were taking 3 dolls, and a heap of garments and complements, which after cut away, one at his{your} pleasure could remove and to put?. promoting or containing hate, racism,
child abuse, animal cruelty or
anything else to that nature.

Any sets using Contemporary artist
are NOT for sale. All sets using
these artists are with permission.
You MUST add their logo & link
back to their site.
5.
NO alterations of ANY kind are made
to this set. That includes
resizing, cutting, mixing and
matching with other sets, etc.
You do not have to use all parts
of the set if you do not need them.
It is bar separate, bullets and
buttoms.
6.Absolutely
NO REDISTRIBUTION of these graphics
in any form. This means that you may
not put the set up on YOUR site and
then GIVE IT AWAY to others!!!!!
